At Maka Studios, we value and protect the privacy of the individuals whose data we process. This Policy is issued in compliance with Law 1581 of 2012, Decree 1074 of 2015 (Title 2, Chapter 25), and other related regulations governing the protection of personal data in Colombia, as well as the habeas data regime.

2. Definitions
- Personal data: any information linked to or that may be associated with one or more specific or identifiable natural persons.
- Sensitive data: data that affects the privacy of the data subject or whose improper use may lead to discrimination (e.g., racial origin, health, biometric data, political orientation, among others).
- Data subject: the natural person whose personal data is subject to processing.
- Data controller: the party that decides on the database and its processing; in this case, Maka Studios.
- Data processor: the party that carries out the processing on behalf of the Controller (e.g., hosting providers, payment gateway, email).
- Authorization: the prior, express, and informed consent of the data subject to process their data.
- Processing: any operation on personal data, such as collection, storage, use, circulation, or deletion.
3. Personal data we collect
Depending on your relationship with Maka Studios, we may collect and process the following categories of data:
- Identification and contact data: name, document type and number, phone, email, city.
- Billing data: company name, Tax ID (NIT) or ID number, billing address, and data necessary for the issuance of electronic invoices.
- Booking data: date, time, contracted service, number of attendees, technical requirements.
- Browsing and technical data: IP address, device and browser type, pages visited, and information collected through cookies (see Cookie Policy).
- Images and recordings: audiovisual material captured in the course of providing the service or for the security of the premises, where applicable.
Maka Studios does not routinely request sensitive data. Should it be required, express and informed authorization will be requested, and the data subject will not be obligated to provide it.
4. Purposes of the processing
Personal data will be processed for the following purposes:
- To manage and confirm bookings, scheduling, and the provision of the contracted services.
- To issue invoices and comply with accounting, tax, and legal obligations.
- To maintain communication with the data subject regarding their booking, quotes, changes, and support.
- To handle requests, complaints, claims, and inquiries (PQR).
- To send commercial information, promotions, news, and content of interest, when the data subject has authorized it.
- To conduct satisfaction surveys and improve the quality of our services and website.
- To manage the security of individuals and the premises.
- To transfer or transmit data to processors that support operations (hosting, payment gateways, messaging, analytics), under confidentiality obligations.
5. Authorization by the data subject
The processing of your data requires your prior authorization, which may be granted in writing, verbally, or through unequivocal conduct that reasonably allows the conclusion that it was granted (for example, by completing a form, making a booking, or writing to us via WhatsApp). Maka Studios will retain proof of the authorization granted.
6. Data of children and adolescents
The processing of data of minors shall proceed only when it serves their best interests, respects their fundamental rights, and has the authorization of their legal representative, having first heard the minor’s opinion where possible.
7. Rights of the data subject
As a data subject, you have the right to:
- Know, update, and rectify your personal data.
- Request proof of the authorization granted, except in cases exempted by law.
- Be informed about the use given to your data.
- File complaints with the Superintendence of Industry and Commerce (SIC) for violations of the law, after first submitting an inquiry or claim to Maka Studios.
- Revoke the authorization and/or request the deletion of your data, when there is no legal or contractual obligation requiring its retention.
- Access, free of charge, your data that has been subject to processing.
8. Procedure to exercise your rights
You may exercise your rights by sending your request to the email audiovisual@makastudios.co or to the physical address indicated, including your name, ID document, contact details, and a clear description of the request.
- Inquiries: will be addressed within a maximum term of ten (10) business days. When it is not possible to address them within that period, the interested party will be informed of the reasons and the response date, which will not exceed five (5) additional business days.
- Claims: will be addressed within a maximum term of fifteen (15) business days counted from the day following their receipt. When it is not possible to address them within that period, the interested party will be informed of the reasons for the delay and the response date, which will not exceed eight (8) additional business days.
9. Transfer and transmission of data
Maka Studios may share personal data with third-party processors that support its operations, such as web hosting providers, payment gateways, email and messaging services, analytics tools, and booking systems. These third parties process the data solely in accordance with Maka Studios’ instructions and under confidentiality and security obligations. Some providers may be located outside Colombia; in such cases, we will endeavor to ensure they have adequate levels of protection.
10. Information security
Maka Studios adopts reasonable technical, human, and administrative measures to protect personal data against unauthorized access, loss, alteration, or misuse. However, no system is completely infallible, so the data subject acknowledges that there is a residual risk inherent to any information processing.
11. Database retention period
Personal data will be retained for as long as necessary to fulfill the purposes described and the applicable legal, accounting, and tax obligations. Once fulfilled, the data will be deleted or anonymized, unless there is a legal duty to retain it.
12. Supervisory authority
The Superintendence of Industry and Commerce (SIC) is the competent authority for personal data protection in Colombia. The data subject may turn to it when they consider their rights have been violated, after exhausting the procedure before Maka Studios.
13. Amendments
Maka Studios may amend this Policy at any time. The version in force will be the one published on this website, with its corresponding update date. Substantial changes will be communicated through the usual channels where appropriate.
